Sued for Wrong Pizza Delivered?
Enjoyed a three day weekend in OC, three adult (40+) couples at my brother-in-laws place. Ordered a couple pizzas and when finally delivered (hour wait), discovered they sent the wrong pizzas. I called and was told they delivered what I ordered, and when I disagreed was told I would have to place ANOTHER order for delivery up to an hour wait. I declined to pay again. The manager refused to acknowledge their error and was incredibly rude and dismissive. I then disputed the charge with my credit card company who AGREED with our dispute and declined the charge. ($50.44 folks) Now a MONTH after the dispute was upheld I get a call from 'Scott', who turns out to be the owner although he didn't disclose that in the voicemail. Here's the first contact from the Owner: "... just to let you know I'm gonna challenge your credit card dispute, and since it's an order you didn't pay for, I'm going to file charges for theft..." Well, that escalated quickly! I did call Scott back and only THEN did he even bother to ask what happened that evening. That call didn't go well either. The first email we received from Scott after the call was " Remember I gave you an opportunity. I guarantee you it will cost you more to defend yourself in court. In Maryland it is illegal to refuse to pay for food once you have received it." I guess we will see it this applies when a completely incorrect order is delivered? Can Pizza Tugos just send a box of whatever to your house and demand payment?
It would have been much easier for this to be resolved the night of, or even after, during the credit card dispute. And even after that to call me and find out our side of the issue.. but no, instead we are threatened not once, but twice.
Beware. And if you DO order delivery from them, be sure to make the delivery person wait while you open and inspect everything.
