Refund refused! -Cancelled event due to lockdown…

We have had to cancel my husbands 70th Birthday celebrations twice due to lockdown. He is now 71 & we want to cancel the event & have asked for our money to be refunded.
Ear candy have refused to refund our money although the government’s guidelines & rules state that businesses should refund due to the lockdown.
Their response is unacceptable. It’s not as though they missed out on booking the band for another event! Our venue have refunded us their booking fee.
Put things right Earcandy and refund the money.

Hi Barbara,

We're sorry to hear that your daughter has had to cancel her booking a second time, things have been very tough for those planning events till the restrictions lift.

The CMA advice relates to services that have not been provided and we can confirm that your daughter should not have been charged for anything other than a booking fee already. However, the first payment is non-refundable as per the terms and conditions of the booking.

I believe that we have offered to liaise with the Act for you to postpone the booking to a more suitable time as a gesture of goodwill and left your daughter a voicemail on the 25th of March 2021, but we have not heard back yet.

please find further information regarding postponement policies due to covid here: https://help.earcandylive.co.uk/knowledge/what-is-the-covid-19-postponement-policy

If this is something your daughter would like to do, we would be delighted to help, so that you can enjoy the band now that things are opening up.

Totally unethical company!

Making money with the Corona-hardship of their customers and artists!
My daughter had to cancel her wedding because of Covid restrictions and with it the booking made with Earcandy. Contrary to government guidance and general decency Earcandy kept all monies which had been paid to them in advance and refused any refunds.
There are two parties who suffer most because of the Covid inflicted cancellation, the wedding couple and the artists. Either the deposit, which was more than £ 1000 should have been paid back to the wedding couple or given to the artists who need to survive somehow in these difficult times. Instead Earcandy decided to pocket the whole amount themselves stating significant upfront costs without being willing (or able) to disclose them.
This company is taking advantage of others in Corona times! Totally disgraceful and despicable!

….and here are my comments to Earcandy’s response:
- Earcandy is hiding behind their own policy, which states that the first payment is non-refundable. This clause is deemed to be unfair and therefore in breach of the Consumer Rights Act 2015, part 2!
- My daughter canceled at the moment that her 140 people wedding had to be restricted to just 30 people. Who then needs an 8-piece Motown Band? (which would have also counted to the 30). Alternative offers for the day were of no use as the style of the wedding had changed to sit down only to comply with Corona restriction. Other dates were also of no interest as the wedding couple lives abroad now. This is all known to Earcandy
- We were charged £ 1150 and Earcandy kept it all! What justification do they have? They did nothing apart from a few phone calls and a few e-mails! Holding all money back is against official government guidance published on the GOV.UK website under 'wedding-services-coronavirus-covid-19-cancellations-and-refunds'
I maintain my judgement that Earcandy’s is a money grabbing business with no interest in their customers or their performers. Otherwise they would have paid the money back or passed it on to the artists who suffer most in Corona times. Don’t get fooled by the nice language they use.

Dear Jane,

We're sorry to hear of your disappointment regarding your Daughter's cancellation of her band booking.

Unfortunately, as is standard policy with entertainment agencies, we are unable to process refunds for the first payment. This policy was explained to your daughter when she originally made the booking with us.

We are sorry to hear that your daughter has gone through difficulties with her wedding date due to restrictions, and we understand the stress and upset you are experiencing in these unprecedented times.

We are sure that you can understand, just as with our performers, our business too does have costs which we must cover to deliver our service.

This business continuity is for the sake of our future customers, many of whom have postponed their events to future years, and of course, our wonderful performers.

It should, however, be noted that your daughter has not been charged the majority of the fees for the event, including second and final payments.

We have offered your daughter the following options, which she has rejected:

1. Offered a free postponement (in almost all cases) to any date before 2024, so that she can enjoy the band at a time when she can have more guests at her event, at no extra charge, even if our prices rise. We can offer this, even if the date is not currently known.

This option is a popular choice when wedding couples have had a scaled-down wedding with fewer guests, but decided to celebrate a reception at a later date, inviting the number of guests that they had initially planned.

2. Transfer the booking over to a family member or friend

3. Change the booking to a smaller Act or an Act that your daughter feels may suit the setting of the wedding better than what she had initially booked.

Of course, these options remain available should your daughter wish to reach out - and we'll always try to be accommodating where we can.

We wish you and your daughter the very best,
The Earcandy Team

Covid cancellation

If there is the slightest of chances your event will be cancelled, avoid Earcandy. I paid £700 holding fee for my wedding band. Unfortunately due to the Corona Virus I had to cancel my wedding. Ear candy have refused to pay me a single penny of my deposit despite giving them a bloody good reason for cancellation and 6 months notice before the event.

Hi Ashley

We understand that you are unhappy because we were unable to refund the first payment for the event that you have booked with us. Our booking policy is clearly stated in our booking terms and conditions and this includes that the first payment is non-refundable in the event of cancellation.

We have offered you to change the date free of charge even if the date in the future is currently unknown, and additionally have offered you to transfer the booking to a family member or friend. For the majority of our customers, we have been able to help support them in this way, however, you have decided not to go with these options.

We understand that you believe that you are entitled to receive a complete refund for your booking. This information from the ABWB may be helpful in clarifying. https://www.abwb.org/post/covid-19-explanation-of-cma-guidance-on-weddings

Whilst we understand that you are unhappy with the outcome, we'd like to thank you for booking with us, and our offer to transfer the booking to another date or a family or friend remains open should you wish to take us up on this.

We wish you all the best for the future,

The Earcandy Team

Helpful and honest booking advice

Earcandy have been very helpful in helping us find our wedding band. We’ve really appreciated the personal touch and the honest advice that was given. We can’t wait to have Soul Fresh perform at our wedding next year.

Pandemic wedding cancellation

We hired Earcandy for our May 31st 2020 wedding. Unfortunately due to the pandemic, we had to cancel our special day. Postponement was sadly not possible, as we are from outside the country, as are the majority of our guests. After several emails exchanged, Earcandy refused to give us our booking fee (or a partial amount) back. The fee was 50% of the total cost. Their response to this being an unfair amount to retain, is that they use the payment to pay for their employees. This company only cares about money, not their customers. Even during a global pandemic, they have no sympathy towards a couple who’s special day was cancelled, and who are losing a lot of money simultaneously. A force majeure event means that 'an unforeseeable circumstance prevents someone from fulfilling their contractual obligations.' As the UK are not allowing gatherings, this means Earcandy cannot perform their service on the date, which we signed the contract for. Therefore I would not recommend anyone to use their services. We are currently following up with a lawyer to hopefully resolve this unfair situation.

***To the Earcandy response below:

'You originally made your booking in June 2019, and since then there has been a significant amount of preparation made for the entertainment for your event.'

-Significant amount of preparation? I'm very sorry but we asked a question in an email or two (three months before our wedding) about the mixes the dj could play. We were then told the dj would get in touch and never heard a word from him. I think the word 'significant' is a bit of an overstatement when we hadn't had contact since the original booking thread in June.

'no further payments that would normally be due are due'

-As per your contract, it says if you cancel 56 days before the event, you will not be liable to pay the rest of the hire fee. We cancelled 57 days before- ergo no further payment is due.

'Our statement about the pandemic, and how we are responding to the current situation can be seen at...

-This does not cover our situation, only covering situations in which you do not lose any money in.

'we could look at the possibility of transferring your booking to someone else.

-This option was never given to us to.

'you told us that you didn't want to do any of these things'

-I never said I didn't 'want' ... I said it is not possible. If an option of postponement was possible, this would be a completely different situation. Nobody 'wants' any of this to be happening.

We hired Motown Gold for our wedding…

We hired Motown Gold for our wedding party..
All I can say is book them early..what an amazing band.. they were fantastic singers, engaging, fun and authentic..
All our guests were blown away and I had my female friends thanking me because they actually got to dance with their husbands who "don't dance" and they all enjoyed every minute..another hour or so of them would have been amazing as we could have danced and listened to them all night..
Thank you to Maggie and her band and thank you Earcandy for matching us up with a perfect group of musicians.
Amazing night. Xx
