Vehicle sold with unverified mileage / Unresolved complaint under Sale of Goods Act
I purchased a commercial vehicle from KNG Motors Ltd (trading online as Only Vans UK at only-vans-uk.co.uk). The vehicle was advertised with 23000 miles. Upon enquiring with the previous registered keeper, the records showed the vehicle had previously recorded 155000 miles. It was also delivered with a hole in the roof of the cargo bay that was well rusted, showing it wasn't new, and they completely denied knowledge of it.
I formally contacted the seller on the day of delivery in writing to reject the vehicle under the Sale of Goods Act 1979 due to misdescription and it not being fit for purpose. KNG Motors Ltd have accepted the rejection, denied fault but failed to return my payment.
I am currently having to go down the route if pursuing formal legal action via the County Court and have reported the mileage discrepancy evidence to Trading Standards."
