Thank you for your comments which are not supported by the facts of the case.
You have referred the matter to our professional body the ACCA which investigated the matter which concluded that your complaint was not supported by the evidence provided.
We note that you have failed to appeal the ACCA's conclusions despite the fact that you were invited to do so.
It remains open for you obtain recourse through the courts.

11.I have considered all of the available evidence and conclude as follows:
12.The Member was engaged to carry out the work as agreed between him and the Complainant, as long as payment was received as detailed in the Letter of Engagement (signed by the Complainant on 6 July 2014).
13.The Member sent reminders that payment was due in order to progress the 2015 tax return, the Complainant states that the reminders were not explicit enough for him to realise that non-payment meant non submission of his return for 2015.
14.The Member also provided evidence that the information required to complete the Self Assessment Tax Return for 2015 was not provided on time.
15.I also note the reminders which were sent regarding the 2017 tax submission deadline dated 16 August 2017, 13 September 2017 and 20 December 2017.
The Complainant has not provided evidence from HMRC regarding the penalty incurred for the 2017 return. The Member maintains that he submitted the 2017 tax return and has provided a screenshot of what appears to be the Complainant’s Sage account showing that the tax return was submitted on 29December 2018,
16. In light of the above, I do not find that the Member has breached any ACCA Rules with respect to the 2015 tax return.
17.In relation to the 2017 tax return, in the absence of any independent evidence I am unable to reconcile.
18.I therefore consider that there is insufficient evidence to conclude that the member’s conduct has resulted in a breach of ACCA rules in respect of the 2017 tax return and this Complaint should be closed.

This concludes ACCA’s consideration of this matter.
