Destroyed My Confidence And Spirit
I am left wondering why these solicitors took my case only to rubbish it and effectively shut it down potentially losing me any compensation or my “day in court”? I began my medical negligence case with a solicitor who, although always civil and pleasant had taken the best part of two years and not made any headway. I changed to Hart Brown because Mark Wisby assured me things would be totally different, prompt and efficient at Hart Brown. Wisby even claimed he was working on an identical case to mine which, now, I question. So I turned down another offer from a reputable practice who were keen to take the case and signed up with Hart Brown. Immediately after doing so, the attitude changed, 180 degrees. On my first call to see how things were progressing around 1 month after engaging Hart Brown, I was treated to a maniacal rant from Mr Wisby, who made it clear that everything about my case was proving difficult for him. He made various assumptions (incorrect) as to what had gone on between myself and my previous solicitors, the circumstances of which had already been explained to him, and were irrelevant, as that was in the past. I was deeply upset by this but worse was to come. I then received an email, with a letter attachment (why he simply didn’t call me, I do not know) telling me that Wisby had approached a doctor with no legal training (it’s important you get a medico legal expert for cases such as this) for an opinion. Too frightened now to call him direct with my query, I called the central number for Hart Brown and asked if I could speak to Wisby’s secretary, so I could leave a message. On being put through, the phone was audibly picked up and then replaced. So, via email now - too frightened to call anyone - I cordially asked, why not a medico legal expert witness? and then I waited, and I waited. It became apparent that Wisby, after being asked why no enquiry was made with a medico legal expert had taken offense and as a punishment, I was getting no timely reply either by phone or email. I sent a follow-up email a few days’ later but still nothing and it is apparent, without telling me he will prolong the case until the statutory limit for prosecution elapses, I guess that is exactly what this firm will allow to happen. Unfortunately, there is now nothing I can do because, understandably, any other firm will be reluctant to take my case.
