Absolutely appalling,

Absolutely appalling,
Clearly did not look into the evidence I provided as most of this was conducted on resort either face to face or over the phone,
Obviously they took the company’s word over the customer which is more than likely due to loyalty between them,
Will not be holidaying abroad as it isn’t worth paying over the odds for a holiday that will more than likely have problems (isn’t the first time), and you (ME) ends up paying Arbitration for the privilege of ruling against the customer,

Thank you for your review. All evidence, provided by both parties, is considered by the arbitrator. If the arbitrator finds against one party then it is the case that he or she has preferred the evidence provided by the other party This does not mean it was not considered. There is no 'loyalty' between the arbitrator and the other party, there is no relationship between them, the arbitrator is completely independent and does not benefit whichever party is successful in the arbitration.

Nobody actually talks to you...... Try calling... Chaotic software.

Appalling Communication, you can never speak to a person, chaotic software, generic emails to problems, more hassle than the complaint they are handling!!!!
Wish I'd never got involved with them. I would simply prefer a refund on my initial payment and walk a way.

A fair, honest and professional company and I am happy with the result. Albeit a slightly slow turnaround due to the volume of cases they deal with but communication was clear and helpful. Would definitely use again.

Easy to use

I thought it would be complicated and wasn't going to bother, but all was straight forward. I did have some issues downloading the correspondence to the portal but my son did it for me! After 6 months I got a positive outcome. So pleased!

Thank you Diane. We had some delays due to the sudden rise in cases once people started to travel again. We are pleased to see you were satisfied in the end.

Your actual words were "I would expect the arbitrator had seen the evidence, thus taking all of it into account" which is just assuming as I said before.

My complaint was backed up with numerous trip advisor reviews ,which are acceptable, but not once were these mentioned at any time, so from the beginning I had no chance of succeeding. Go to the small claims court, it is so much easier and made clear as to what happens. I don't even know if my evidence was taken into account.
This is an update after reading their reply. Before I submitted this review I asked whether the Arbitrator had looked at the reviews as evidence and they could not confirm this, they still can't - they only assume so because it was uploaded.

Thank you for your edited review. This is an edited response. the original response stated: "We understand that you will be unhappy if you have not had a decision you were hoping for. Please be assured your evidence was considered by the arbitrator."

However, in your edited response, you still say "Before I submitted this review I asked whether the Arbitrator had looked at the reviews as evidence and they could not confirm this, they still can't - they only assume so because it was uploaded."

That is clearly misleading, We clearly replied "Please be assured your evidence was considered by the arbitrator."

Bad experience.

Bad experience.
The process was slow, communication wasn’t great and “action dates” were often missed, not major issues, but compounded by the fact that when the arbitrator did make his final decision, he got basic details of the case completely wrong. The details were pivotal to the case, and well evidenced. It’s frankly unacceptable for an “award” be made based on information that is factually wrong.
I suspect that the arbitrator did not have the time/motivation to review the case with any seriousness, but it also possible that the potential for these large travel firms to partner with a different arbitration firm for their future work loads does affect Hunt ADR’s impartiality. Either way, aside from the financial implications, it’s deeply frustrating that the travel agency has not been held to account. The travel agency in question has countless negative reviews for ripping people off in similar ways to what I experienced, and certainly in my case they have now been allowed to act with impunity.
It should be noted that before leaving this review, I did contact Hunt ADR directly to resolve this. With regards to their complaint’s procedure, I was told;
As you are aware, in line with our Service Complaints Procedure, we are only able to accept and investigate specific types of complaints, and I must remind you that the complaints which we are not able to accept are those which concern:
• the content of an Arbitration Award;
• the process undertaken by the Arbitrator in reaching their decision; or
• the validity of the procedures, rules, or timescales for the Scheme.
Refusing to accept complaints on the above points seems utterly ridiculous, as it basically means they will not accept complaints about any aspect of the service they offer!!!
When I did lodge a complaint, it took 5-6weeks to receive a response, and this was only after I prompted them. Their response was just to reiterate the above, and not to address the issues raised in my complaint.
I have now asked for the CEO to review the situation and have asked for details of any governing bodies that regulate the arbitration industry, so Hunt ADR’s handling of my case can be reviewed by an external party.
I would strongly advise using the small claims court instead of Hunt ADR.

Fair arbitration starts with selection of arbritrator

Tui refused to provide a detailed response as required by the ABTA Code 5b.
ABTA refused to investigate 15 breaches of Code and suggested I use their Arbitrator which will cost even more money.
Arbitrators are normally chosen by agreement by both parties, often from a list presented to them. This supports independency. I am sure HUNT would agree with this principle.
But ABTA dont appear to give this option and therefore the process starts from lack of independence or trust. I now see that HUNT receive majority negative feedback from people that have used them. So, the Law it will have to be
UPDATE Abta have confirmed again, internal review. Up to 6 mths to carry out. Not commented on arbitration process being totally selected by them. In summary, no comfort to consumers other than financial if the tour operator goes bust. They are supporting a Tui complaints process designed not to answer detail of any complaint, even when possible fraud and breach of GDPR has occurred.
In response to HUNT - in my experience arbiters are not chosen by the party looking after the interests of the alleged party. You are not a judge so comparison invalid. Most of the positive reviews I have read about HUNT relate to training services. You appear to have not indicated the percentage of your income for arbritation services coming just from ABTA, no doubt commercial secret. I will judge on your lack of transparency. Beware consumers, especially those of Tui who will not give you a detailed response, as require by the Code which has no teeth, even if there is suspected fraud, WHICH THEY REFUSE TO COMMENT.

Thank you. We are not ABTA's arbitrator. We are an independent arbitration service, we are not influenced by ABTA at all. You are correct that often (in commercial disputes) arbitrators are chosen by parties in agreement. This is often where there are three arbitrators and it is very expensive. You will be hard pushed to find any ADR body which provides for a consumer dispute to be adjudicated by an arbitrator or an ombudsman to have a selection process. This is similar to the courts where you would not be expected to be able to choose the judge. With regards to "majority negative feedback" we have had 131 reviews and 21 of these have been negative. Negative reviews are common for a dispute resolution provider which provides a service where in every case one party will lose. Looking at it another way, we have had nearly 4000 arbitration cases and 21 negative reviews.

We complained to TUI regarding a holiday sold and they didn’t agree so we decided to go further we were only offered this company so we paid the fee and we are still waiting for a resolution I have never experienced such rubbish customer service in my life they do not want to help you and just keep saying we are very busy. Do they not realise that we only complain when we have had a rubbish experience and expect a resolution within a good time line and not still waiting 12 months after the initial complaint definitely avoid, it’s obvious that this company have been added to represent TUI and not the actual customer complaining

Unregulated Corrupt organisation used…

Unregulated Corrupt organisation used by ABTA.

I have just used this appalling Organisation. ABTA directed me to HUNT after Jet 2 sold a package holiday full of service failures under the package holiday act 2018.

Unfortunately, HUNT will effectively steal your money and then deliberately put the case in favour of Jet 2 from my experience 2022.

The staff at HUNT are completely rude and unprofessional. The organisation will then fail to explain the process and in turn fail to use your evidence.

The case took over 6 months before anyone looked into the case. Nobody including the arbitrator will contact you during your case. Before you know it, your case will automatically fail in favour of the travel firm leaving you with further debt to pay.

I decided to make a formal complaint, the complaints manager was totally unprofessional in not accepting any service failures.

Basically, HUNT is completely corrupt and offers no help with your complaints against Jet 2 in my experience.

The organisation is totally biased and corrupt in every aspect. I can’t stress enough, do not use this corrupt organisation through ABTA!

FACT ~ HUNT are not regulated like most decent firms. This means, they make their own rules up leaving you isolated from reaching out for additional support.

The package holiday act 2018 Requires travel Arbitration firms to adhere to these rules. if you’re a victim of this act, the travel firm must adhere to this act. HUNT appears to turn a blind eye to the act and will automatically deny you of any fair chance of having your case investigated. Once, you lose your case, you have a further option to have your case reviewed in an appeal with another of HUNTS arbitrator. This costs around an additional £400. It’s obvious here, they have put this amount in place to put you off. What person would give the HUNT any more money when they have demonstrated what a scammer would do to someone. I feel Scammed by HUNT when you go to lengths to provide independent reports with substantial evidence that is not considered by HUNT!

My advice to anyone thinking of using HUNT don’t ! I would consider the small claims court after speaking to the travel firm. At least, you will have a chance here with trusted people unlike this corrupt organisation!

I don’t understand who would work at this organisation, they’re complete scammers and would hope, trading standards will close this organisation down shortly. Absolutely disgusting organisation that have left my family out of pocket!!

😡😡😡😡😡😡😡😡😡

I have now escalated the complaint to senior management of HUNT who’s name incidentally is the same name as the Firm.

~~~~~~~~~~~~~~~
I’ve received a final response from HUNT stating that most customers will read my review and think I’m being aggressive. I’m a very nice person who wanted a family holiday from Jet 2 at a cost of over £5000 but didn’t get one as agreed under 2018 package holiday act. HUNT have fully protected Jet 2 at all costs despite demonstrating clear substantial evidence Jet 2 breached the contract. HUNT have responded stating they’re going to update this review soon with their own response, however please don’t be fooled by HUNT. I will now continue to escalate this complaint to trading standards as HUNT do not like being told the truth in that they protect travel companies like JET 2 at all costs even if this mean turning a blind eye to independent evidence reports. HUNT know exactly how to protect travel organisations, it’s almost laughable to see how unprofessional they’re. My advice again, stay clear of HUNT.
~~~~~~~~~~~~~
NEW UPDATE FROM HUNT WITH MY REACTION 😡

As stated, Hunt have now exhausted their complaints procedure and issued their final response below 23 August 2023 to attempt to judge my opinion in that I’ve issued Misleading information and that my tone was aggressive. May I explain, in this timeframe neither manager or CEO has contacted me directly to discuss the complaint in person. HUNT are never to be trusted in any situation regarding your much needed case facts. The only person at HUNT you will speak with is an aggressive lady who has great pleasure in being rude and unhelpful providing misleading information.

HUNT ignored the evidence I gave to them period! which was substantial! HUNT stated they’re cheap in their trust pilot response, they’re are cheap for one reason, they’re truly unprofessional and will leave you financially worse off. HUNT and ABTA want to give the impression ABTA’s dedicated arbitration team (HUNT) are economical for all users. It’s nothing but a tactic to wear you out forcing you to surrender.

ABTA were fully responsible for choosing HUNT as an arbitration. HUNT stated I chose HUNT, absolutely incorrect statement from the head of HUNT. HUNT are nothing but Scammers who operate with ABTA

Reply from Hunt ADR Limited

Dear Mr Massey. As promised, I am now posting our final reply on your reviews of our service.

Although it is clear to anybody who takes the trouble to read the Scheme Rules, explanatory notes, and FAQs, I should offer the following explanation, lest anybody reading your review is misled by the aggressive tone of it into believing there is the slightest justification for any of the criticisms you make.

You booked a holiday with a company which failed to come up to your expectations, but you are only entitled to receive compensation if, as a matter of legal principle, you can show there has been a breach of contract and you have suffered a loss as a consequence of the breach. This is the case whether you bring proceedings in Court or Arbitration.

You chose arbitration, the choice was entirely yours – there are advantages and disadvantages of using one or other dispute resolution process, but both the Courts and the Scheme are governed by rules that are intended to ensure that the dispute is resolved fairly to both parties. Fees under the Scheme are considerably lower than in Court, due to it being “documents only” and administered entirely online.

ABTA is independent of the travel companies and its role is to ensure that standards are maintained for the protection of travelers. The Arbitration Scheme offered is intended to be a straightforward, cost-effective way of resolving disputes which are otherwise unable to be resolved between travel companies and their customers. It is one of the longest established and most well used consumer arbitration schemes in the world.

Our role is to administer the scheme independently of ABTA. Our role is to make sure the arbitration process runs as smoothly as possible, but other than generic openly available guidance, we cannot give advice to either party on how they present their case or the sort of evidence which is necessary to establish the key requirement of a breach of contract – to do might suggest a lack of impartiality. If a party is unsure about the process, it is important to get proper advice from a lawyer, but generally it is designed to be as user friendly as possible.

We also maintain a panel of professional arbitrators who decide the dispute fairly and impartially based on the information and documentary evidence that is brought to their attention. These arbitrators are independent of us, we have no control over the decision they reach. It should be obvious that this means they are also independent of ABTA its members – there is simply no reason even to suggest that the arbitrators are “protecting” travel firms, nor do they.

It will always be the case that a Claimant who is unable to show that there has been a breach of contract or that he has suffered a financial loss as a consequence, will not be entitled to compensation. The process is clearly set out in the Scheme Rules and it is not the task of us or of the arbitrator to carry out a running investigation into the allegations that are the subject of the dispute – the obligation, which is precisely the same as in a court of law – is that the Claimant has the burden of proving the allegations he is making.

Obviously, the party losing the case is unlikely to be happy about it, but the Scheme requires the arbitrator to set out the reasons for the decision so that the parties can at least understand how it was reached.

Because arbitration is a confidential process, we are unable to discuss the arbitrator’s 20 page Award in your case, but you were advised that you had a right to appeal the decision if you thought the arbitrator had gone wrong, and chose not to do so. Again, the rules of the Scheme clearly set out the appeal process, and it is considerably easier to do so than it is to appeal a judge’s decision.

This is our final response on this matter, we cannot continue to go round in circles on this platform or elsewhere, and felt it was important to make these points for the benefit of other readers.
