Disgraceful service - ignoring legal return rights (Order #295438082)

I returned my order via Hermes on Jan 17th. Hermes officially admitted a "processing error" (Bearbeitungsfehler) and failed to deliver the package to the shop, attempting to send it back to me instead. Under EU Law (Directive 2011/83/EU) and Dutch Law, the transport risk for returns lies with the trader.
​I have provided the shipping receipt and Hermes' admission of guilt, yet e-mediaweb.nl is completely ignoring my emails and holding my money hostage. This is a clear violation of consumer rights. I have already refused the forced return from Hermes and demand my refund immediately.

Ein Update zu meiner Odyssee mit e-mediaweb und Saturn: Hermes hat nun schriftlich bestätigt, dass das Paket unauffindbar ist (Status: „we are currently unable to find your shipment“). Obwohl der Händler mir zuvor schriftlich zugesichert hatte, das Geld bei Verlust sofort zu erstatten, weigern sie sich nun erneut.
​Sie verlangen jetzt, dass ich das Ende einer wochenlangen internen Nachforschung abwarte. Das ist rechtlich völlig haltlos (§ 357 Abs. 4 BGB) – das Versandrisiko liegt beim Händler. Saturn schaut bei dieser offensichtlichen Verletzung von Kundenrechten einfach nur zu und leistet keinerlei Hilfe.

Update 11.02.2026:

Hermes has now officially confirmed that my return parcel is lost. Despite the seller's previous promise to issue a refund once the loss is proven, they are now stalling again. They want me to wait for the results of an internal investigation that could take weeks.
​This is a direct violation of consumer rights (§ 357 Abs. 4 BGB). I have provided all the proof, but e-mediaweb continues to hold my money illegally. Saturn, as the platform, provides zero support.
