I entrusted Litkraft Solicitors (now trading as 3M Solicitors Limited) with my hand injury claim. Instead of progressing my case properly, I believe the firm handled matters in a careless and unprofessional way, including the treatment of my most sensitive data.
Through a Data Subject Access Request (DSAR) I discovered that Litkraft had circulated my highly intimate gynaecological records – including examination notes and even images – which were entirely unrelated to my hand injury. These records were shared internally on more than one occasion and disclosed to the external company Premex Services Ltd, which in turn passed them on to at least two further individuals, as shown in the DSAR logs.
Under UK data protection law, such gynaecological and medical records are classified as special category personal data, which must be handled with the highest level of protection. The fact that these records were disclosed without any justification makes the situation even more serious.
When it came to disclosure to Probitas 1492 Syndicate, Litkraft failed to provide this information, despite being legally obliged to. Because of this failure, I have been left with ongoing uncertainty as to whether my intimate records were also shared with Probitas and their solicitors RPC LLP. None of these parties have answered a simple question: have my medical records been received – yes or no?
This experience has left me humiliated and extremely distressed – knowing that outsiders may have had access to medical information which had nothing to do with my case. I feel deceived and betrayed by a law firm that was supposed to protect my interests.
If you have ever been a client of this firm, especially in cases involving sensitive medical evidence, I would strongly suggest checking whether your private records were also inappropriately shared.
